New Machinery Regulation (II): Harmonized Standards

The Regulation
(EU) 2023/1230
a revised version of the current version of the
Directive 2006/42/EC, entered into force on July 19 and will apply to
as of January 20, 2027, when it will be replaced and repealed.

 The new
the European Machinery Regulation introduces a series of modifications compared to
Directive 2006/42/EC, some of which will have a significant impact
in the construction and mining machinery sector. Each of these
changes will be gradually addressed in this section.

 We started this
collection of articles on the new machinery regulation in issue OP251
examining the provisions relating to conformity assessment. In the
present number we will analyze the role of harmonized standards that establish
a presumption of conformity for products falling within the scope of
Application of this Regulation.

 The rules
harmonized European standards constitute an essential tool for helping
manufacturers to design and manufacture machines that meet the essential requirements
of health and safety established in specific machine legislation
of the European Union.

 In the
current events, Directive 2006/42/EC has a list of nearly 800 references
of harmonized standards, which reaffirms the importance of standardization as
instrument in support of the Union's technical harmonization legislation
Europe. All these standards will have to be reviewed to ensure that
the first list of harmonized standards drawn up in support of the new Regulation
of machines contain as many references as possible.
