On April 10, the Royal
Decree 164/2025 of March 4, approving the
New Fire Safety Regulations for Industrial Establishments
(RSCIEI) and repeals the previous Royal Decree 2267/2004.
This new Regulation establishes the necessary conditions
to ensure an adequate level of fire safety in
industrial facilities and seeks to adapt technical and regulatory advancements,
both at national and community levels. Within its main objectives
they find fire prevention, limiting its spread, and
facilitating its extinction, thereby minimizing harm to people,
goods and environment.
Apart from the creation of this new Regulation, this Royal
Decree promotes the following changes related to safety against
fires
- Modify the Royal Decree
513/2017, which was intended to determine the conditions and the
requirements applicable to the design, installation/application, maintenance and
inspection of equipment, systems, and components that make up the
active fire protection systems. - Modifications to the Basic Document DB-SI “Safety in Case of Fire” of the Technical Building Code.
- Modifications to the conditions that fire extinguishers installed in vehicles for the transport of persons or goods must meet
The Regulations approved by this Royal Decree shall be
application to new industrial establishments that are built or
implanted from their entry into force. Industrial establishments already
existing prior to the entry into force of the Regulation approved by
this royal decree will not have to be mandatorily adapted to the new
requirements, and will continue to be governed by the regulations that applied to them
application previously, except for some provisions mentioned within
this Regulation.
The entry into force of this Royal Decree will take place
to the month of the publication date in the Official State Gazette and the
modifications introduced by the third, fourth, final provisions,
fifth and sixth shall apply six months after entry
in force as of this Royal Decree.
