Forthcoming entry into force of the Carbon Border Adjustment Mechanism (CBAM)

Starting January 1, 2026, the definitive phase of the CBAM begins. Authorized declarants will be required to declare each year the quantity of goods imported into the EU in the previous year and the implicit Greenhouse Gas (GHG) emissions.

The transitional period of Carbon Border Adjustment Mechanism (CBAM) approved by the European Union in October 2023 comes to an end next December 31, 2025 and from the January 1, 2026 the definitive period begins, where importers to the EU will have to register as Authorized Declarant Submit a CBAM Annual Declaration (by May 31st) reporting embedded carbon emissions in your products (steel, cement, etc.) for the prior calendar year, handing over equivalent CBAM certificates and obtaining third-party verification, as well as purchasing certificates to cover emissions, though the sale of certificates for 2026 will commence in February 2027, deferring the financial burden.

 The CBAM addresses the risk of carbon leakage, which occurs when, due to costs arising from climate policies, companies in certain industrial sectors or subsectors shift their production to other countries, or when imports from these countries replace equivalent products that are less greenhouse gas-intensive.

The CBAM is expected to contribute to promoting decarbonization in third countries by acting as a benchmark that drives the adoption of measures establishing a fair price for carbon emissions from the production of specific goods.
